This is a rehearing of the case decided at the last term, 124 N. C., 540. Neither a single fact nor a single authority is alleged to have been overlooked. Indeed, no new authority is cited for the rehearing. The ease stands precisely upon the same facts and authorities as upon the former hearing, and the Court has repeatedly said that in such ease the petition for rehearing will not be allowed, but will be dismissed.
