Petite was tried and convicted of murder in the first degree. His motions for a new trial and in arrest were denied. Sentence of death being duly pronounced, the judgment and proceedings were brought to this court for review.
But two of the errors assigned are argued by counsel. I. Plaintiff in error did not take the witness stand and testify in his own behalf.
