The statement of claim charged the violation of the Medical Practice act of 1899, section 9 of which provides: “Any person practicing medicine or surgery or treating human ailments in the State without a certificate issued by this board in compliance with the provisions of this act * * * shall, for each and every instance for such practice or violation, forfeit and pay to the People of the State of Illinois, for the use of said board of health, the sum of $100 for the first offense and $200 for each subsequent offense, the same to be recovered in an action of debt,” etc.
