Henley J. Ambrose filed suit against St. Joseph’s Hospital of Atlanta, Inc. (the “hospital”), alleging that he was burned by a microscope used during spinal surgery. The trial court granted the hospital’s motion to dismiss the suit for failure to file an expert affidavit. Ambrose appeals, contending the trial court erred in dismissing his suit because (1) his claims are based on ordinary negligence, not allegations involving professional malpractice and (2) the allegations involve institutional negligence, not the conduct of any professional listed in OCGA § 9-11-9.1 (g).
