—Appeal from a judgment of the Supreme Court (Feldstein, J.), entered April 2, 2002 in Franklin County, which denied petitioner’s application for a writ of habeas corpus, in a proceeding pursuant to CPLR article 70, without a hearing.

In July 1996, petitioner was convicted upon his plea of guilty of the crime of arson in the second degree. He was sentenced as a second felony offender to an indeterminate prison term of 6 to 12 years. The judgment of conviction was affirmed on appeal to the Second Department (People v Walsh, 243 AD2d 590 [1997], lv denied 91 NY2d 899 [1998]). Petitioner’s…
