AMENDED OPINION & ORDER
ACKERMAN, Senior District Judge.
This case comes before the Court on Plaintiffs motion to remand this action to state court. For the reasons outlined below, Plaintiffs motion is GRANTED.
Background
In her complaint, Plaintiff Erma Buchanan (“Plaintiff’) alleges the following facts: On January 25, 2002, a commercial truck owned by Defendant National Carriers, Inc.
