MEMORANDUM AND OPINION ORDER
KEELEY, District Judge.
I. PROCEDURAL BACKGROUND
On June 4, 1997, Catherine Morehead filed a Chapter 7 Bankruptcy Petition on behalf of herself and her husband, Raymond Morehead, in the United States Bankruptcy Court for the Northern District of West Virginia. Three separate appeals stemming from this bankruptcy proceeding have been filed with this Court. On December 20,1999, this Court affirmed the bankruptcy court’s rulings in the appeal filed by the Moreheads’ creditor Lind-Waldock. See Lind-Waldock v. Morehead, Civil Action No. 1:98CV125.
