This case presents mainly questions of fact, although a great many points in relation to the admission and rejection of testimony are also preserved. As all the testimony, whether rejected or admitted, is found in the record, an ex-*534animation and decision of these points becomes unnecessary in view of the conclusion we have reached upon the whole case.
