This case comes before us on an appeal from a decree made by the chancellor for the third judicial circuit- A decree has heretofore been made by this court, as a court of chancery, before the present system was adopted. The decree was made on a full hearing, and it was referred to Mr. Allen, a commissioner specially appointed, to take the account between the parties.
