This is an action in damages based upon an alleged breach of contract of bailment.
The facts of record are that plaintiff was the owner of a certain steam shovel, boiler and equipment; the defendants were a partnership doing business under the name of Spitcaufsky Brothers, at Kansas City, Missouri, and at the time of the occurrence giving rise to this action, were engaged in excavating what is known as the Main street cut, just south of the present Union Station in Kansas City, Missouri, extending from 24th to 27th streets in said city.
