1. In Appert v. Brownsville Co. (C. C.) 144 Fed. 117, and in Schmertz Wire-Glass Co. v. Pittsburgh Plate Glass Co. (C. C.) 168 Fed. 73, the history of the issuance of the Schmertz patents in obedience to an order of the Circuit Court for the Western District of Pennsylvania in a proceeding under section 4915, Rev. St. (U. S. Comp. St. 1901, p. 3392), is given.
