The complaint here is that the court erred in refusing to dismiss the affidavit of illegality filed by the defendant in error to an execution issued upon a judgment in favor of the plaintiff in error against the defendant in error. The main ground relied upon in the *551affidavit of illegality is this: that certain property, as the property of Wilder, had been levied on by the execution in this ease, and claimed by Mrs. Mary B.
