Wetzel, J.), entered on or about May 17, 2004, which granted defendant’s motion to suppress physical evidence, and order, same court and Justice, entered on or about June 7, 2004, which, to the extent appealable, dismissed the indictment, unanimously reversed, on the law and the facts, the motion to suppress denied, the indictment reinstated and the matter remanded for further proceedings.
