This action by the plaintiff, W. R. Roberts, against the defendants, Joe W. James and O. B. Hartzog, partners doing business under the name and style of the Alliance Bonded Warehouse, commenced in the Court of Common Pleas for Greenville County, August 6, 1929, is based upon a deposit of seventeen bales of cotton by the plaintiff with the defendants, and the failure of the defendants to deliver the said cotton to the plaintiff when the same was called for by him.
