Defendant appeals from a judgment convicting him upon a jury verdict of criminal possession of a weapon in the third degree, and sentencing him as a predicate felon to a term of 2 to 4 years. He assigns as error the denial of his motion to suppress a shotgun found in his brother’s car and claims that the search of the vehicle was improper, since there was lacking probable cause that he had committed or was committing a crime.
