OPINION OF THE COURT
KRAUSE, Circuit Judge.
Our federalist system of government accords respect for the sovereignty of the States in a variety of ways, including the Eleventh Amendment to the United States Constitution, which immunizes States from suits brought in federal court by both their own citizens and citizens of other States. The Eleventh Amendment’s protection, however, is not limited to the States alone, but rather extends to entities that function as “arms of the State.” In this case, we are asked to resolve a split among the district courts in our Circuit as to whether Mont-clair…
