MEMORANDUM AND ORDER ON MOTIONS TO QUASH

SOROKIN, United States Chief Magistrate Judge.

At issue in the motions to quash filed in these two cases is not the right of a copyright holder to enforce its copyright, but rather the proper application of the rules governing early ex parte discovery from persons who are not (at least at this time) parties to the pending lawsuit.1 The issues are of particular importance because to some extent, Congress has protected the privacy of these third parties.
