Like a swallow returning to Capistrano, this case is once again back in the Southern District of Florida. The principal question on this third go-around is whether Secretary of State Katherine Harris is entitled to remove the action pursuant to 28 U.S.C. § 1443(2) due to the state court’s exercise of jurisdiction after the remand of Brown, et al. v.
