Ormsby to procure his discharge from custody on a bench warrant issued by the Supreme Court of the District of Columbia. From the order discharging the writ, petitioner appeals.

KNAPPEN, Circuit Judge.
On April 5, 1909, petitioner, George E. Ormsby, was indicted in the Supreme Court of the District of Columbia on a charge of criminal libel. Pie pleaded not guilty; his trial resulting in a verdict of guilty rendered on May 24, 1910. Motions for new trial and in arrest of judgment were overruled July IS, 1910. Sentence has never been imposed.
