delivered the Opinion of the Court,

This bill was filed by a portion of the heirs of Atkinson Hill, deceased, against his executor, Wilford Lee, and the remaining heirs, for the purpose of coercing a settlement and distribution of the decedent’s estate.

The executor sets up a partial settlement made with the County Court, a short time before the commencement of the suit; and, in an amended answer, presents and relies on a second settlement, made under a new or*38der of the County Court, while the suit was pending.
