This action was instituted to recover damages for personal injuries alleged to have been sustained by the plaintiff on the 20th day of May, 1925. The plaintiff was the wife of one John A. Tucker, who rented a four-room apartment in the defendant’s tenement house located at 697 East One Hundred and Thirty-second street. The apartment consisted of four rooms and bath. The bath room contained a bath tub supplied with hot and cold *403water by the defendant.
