Alva Darnell Freeman, hereinafter referred to as defendant, was charged by an information filed in the district court of Oklahoma county with the crime of murder; was tried, found guilty by verdict of the' jury of manslaughter in the first degree, but the jury left the punishment to be fixed by the court; thereafter, the defendant was given the minimum sentence of four years imprisonment in the penitentiary, and has appealed.
