The question presented by the record is whether the ordinance of the town of Olive Branch, a municipality governed by chapter 93 of the annotated code of 1892, closing and vacating Blocker avenue, was a good-defense to appellant, who was in-*723dieted under § 1145 of said code for obstructing a public highway.
