Dennis was indicted for the offense of assault with intent to murder. The jury returned a verdict of guilty of that offense but recommended a misdemeanor punishment, and the judge sentenced him in accordance with the recommendation.

Counsel for the defendant argues first that the evidence does not support the verdict.
