delivered the opinion of the Court.

The Solicitor General has requested the reconsideration of the judgment rendered in the case at bar, which reversed *495the one rendered by the Superior Court. We reversed on the ground that the prosecuting attorney had referred to the silence of defendant, against the provisions of § 11 of the Bill of Rights of our Constitution.

The State holds that we erred in applying the law to the facts. We set forth the facts again insofar as they are pertinent to the application of the above-mentioned constitutional provision.
