Appeal from a judgment of the Supreme Court, (Connor, J.), entered May 14, 1986 in Albany County, which, in a proceeding pursuant to CPLR article 78, dismissed the petition based on the expiration of the Statute of Limitations.
Petitioner was appointed to the rank of captain in the City of Cohoes Fire Department on November 28, 1979 and held the position until July 17, 1981, when he and one other captain were demoted due to departmental cutbacks.
