Affirming.

On July 27, 1935, between the hours of 11 and 12 o’clock p. m., the appellant, Carl Landrum, a young man past 21 years of age, killed George Wilson, a boy 16 years of age, on the streets of Jackson, Ky., by striking him in tire head with a bottle, from the effects of which he immediately slumped upon the side walk where he was standing and later died therefrom without regaining consciousness.
