KENNERLY, District Judge.

This is a libel, filed March 17, 1927, under the Act of Congress of March 9, 1920 (c. 95, § 3, 41 Stat. 526, 46 USCA § 743), in which libelant sought to recover from respondent, damages resulting from a collision between the vessel of libelant and the vessel of respondent on March 16, 1927, and in which, on August 23, 1928, there was interlocutory decree for libelant with a reference to a commissioner to ascertain the damages.
