delivered the opinion of the court.

This appeal is prosecuted by appellant to reverse a judgment in the sum of $12,500, rendered by the city court of East St. Louis in favor of appellee.

The declaration consists of two counts. The first count charges among other things that on November 14, 1924, appellant, an Illinois corporation, was possessed of and operating a certain restaurant or cafeteria at 620 Washington avenue in the City of St. Louis, Missouri; that on the second floor of said building it used and operated a certain steam counter, situated on a porcelain…
