For convenience we refer to Perry G. McBride, the father, as plaintiff, and to Perry F. McBride, the son, as defendant. Plaintiff appeals from an order denying his motion for amended findings or for a new trial.

The plaintiff and Delphine B. McBride were husband and wife and had been such for many years, although for a long period of time they lived apart. On July 21, 1933, the wife executed her last will and testament, leaving all her estate to her son, the defendant.
