The plaintiffs in the court below filed a petition against the defendants to recover a two-thirds undivided interest in certain land, including lot 135 in the 7th land district of Gwinnett Count}', containing 250 acres, more or less; to have the same partitioned and sold; for injunction, etc. Later the petition *136was so amended as to dismiss the action as to all land except lot 135; and the jury found a verdict for the plaintiffs as to this lot. The defendants made a motion for a new trial, which was overruled, and they excepted.
