Perry Frezzell (Defendant) appeals from the trial court’s judgment and sentence entered after a jury verdict finding him guilty of assault in the third degree in violation of Section 565.070 RSMo 1994, and knowingly committing violence to an employee of the department of corrections in violation of Section 217.385 RSMo Cum. Supp.1997. The trial court sentenced Defendant, as a prior offender, to fifteen days in the county jail and six years in the department of corrections.
