KRUEGER, Judge.

Appellant was convicted of the offense of murder and his punishment assessed at confinement in the State penitentiary for a term of ten years.

By Bill of Exception No. 1 he questions the validity of the indictment upon which he was convicted of the offense therein charged. It appears that on or about the 9th day of October, A.
