This is an appeal from an order dismissing-the appeal taking by the present appellant to the circuit court; from a judgment entered in a justice’s court. About September 1, 1898, Hie respondent recovered judgment in the justice's court against the appellant; and the appellant thereupon, within two or three days, perfected his appeal to the circuit court by serving and filing his notice of appeal, and filing two under takings,- — one for costs on appeal, and the other to stay execution on the judgment.
