Plaintiff, on November 22, 1915, made a written application for retirement from the Army in the grade of Chief Musician, which grade he then held, having been appointed to it on the preceding September 9. When plaintiff made his application on November 22, he had not completed the thirty years of service necessary for retirement, but was one week short of it.
