At the May Term, 1936, of Lincoln County, the respondent was indicted for murder, tried and convicted of that crime.
After verdict and before judgment he presented to the Justice presiding a motion to set aside the verdict and grant a new trial.
On denial of the motion, he took an appeal to the Law Court, as provided by R. S., Chap. 146, Sec. 27.
On such appeal the question is whether, in view of fill the evidence in the case, the jury was warranted in believing beyond a reasonable doubt, and therefore in finding, that the defendant was guilty of *209the crime charged against him. State v. Lambert,…
