Allen Kindred brought this action against City of Omaha Employees’ Retirement System (Retirement System) for reimbursement of attorney fees which he paid in connection with his workers’ compensation action against the city of Omaha (City), his former employer. Pursuant to a city ordinance, the monthly disability benefits which Kindred receives from Retirement System are reduced by the amount of his workers’ compensation benefits.
