LANIER, Judge.

The procedural issue in this case is whether a party defendant who obtains a judgment on the merits in his favor can thereafter obtain a new trial on a jury’s quantum award.

FACTS

At approximately 7:50 a.m. on January 31, 1984, Michael Bridevaux was driving a 1983 Ford pickup truck owned by Royal Refrigeration Company, Inc. (Royal) in a westerly direction on Louisiana Highway 37 near its intersection with Sherwood Forest Boulevard in East Baton Rouge Parish, Louisiana.
