Plaintiffs in error, hereinafter referred to as plaintiffs, instituted this action on December 2, 1960, alleging, inter alia, in substance, that they were owners of real estate in College Park Addition to Oklahoma City; that defendants in error, hereinafter referred to as defendants, had attempted to create a water distribution system known as Water Assessment District No. 2, for said Addition, and would, unless enjoined by the court, let a contract on December 6, 1960, for the construction of such a system, costing $291,319, and then proceed to construct such…
