SCHOTT, Judge.

This executive officer suit by plaintiff, Wallace J. Carter, against David L. Poin-dexter, John McKee, and Robert Gersten-korn,1 arises out of plaintiff’s contracting silicosis from working with and around dia-tomaceous earth during his employment in the earth-regenerating plant at the American Sugar Refinery in Arabi, Louisiana, from 1960 to 1971. The case was tried before a commissioner of the Civil District Court who recommended dismissal of plaintiff’s suit.
