— Order unanimously modified on the law and as modified affirmed without costs and matter remitted to Supreme Court, Allegany County, for further proceedings, in accordance with the following memorandum: Pursuant to an oral stipulation, incorporated but not merged in a 1981 judgment of divorce, defendant agreed to pay plaintiff $50,000 per year in weekly installments as unallocated maintenance and child support.
