Cross appeals from an order of the Supreme Court (McGrath, J.), entered May 31, 2012 in Rensselaer County, which denied plaintiffs’ motion for partial summary judgment on the issue of liability pursuant to Labor Law § 240 (1) and denied defendant’s cross motion for partial summary judgment dismissing the common-law negligence and Labor Law § 200 causes of action.
