Plaintiff Brian Kodish (“Kodish” or “Plaintiff’) moves this Court pursuant to Rule 37 of the Federal Rules of Civil Procedure, to compel Defendants Oakbrook Terrace Fire Protection District (“Fire District”), Gregory J. Sebesta (“Sebesta”), Donald Ventura (“Ven-tura”), Andy Sarallo (“Sarallo”), and Joe Dragovich (“Dragovich”) (collectively “Defendants”) to produce the audiotape of the Fire District board meeting closed session held by the Defendants on August 11, 2004.
