This is an appeal from a judgment reversing a decision of the joint board of the department of labor and industries and remanding the cause to the department for further hearing and decision.

The appeal arises out of the following facts: John Booth, the husband of respondent, was killed on Feb ruary 16, 1928, while employed as a miner engaged in extrahazardous work as defined by the workmen’s compensation act.
