*891In a claim to recover damages for unjust conviction and imprisonment pursuant to Court of Claims Act § 8-b, the defendant appeals, as limited by its brief, from so much of an order of the Court of Claims (Marin, J.), dated December 5, 2006, as denied its cross motion for summary judgment dismissing the claim, and the claimant cross-appeals, as limited by his brief, from so much of the same order as denied his motion for summary judgment on the issue of liability.
Ordered that the order is affirmed, without costs or disbursements.
