ORDER

WILLIAM H. STEELE, Chief Judge.

This matter is before the Court on the defendant’s motion to dismiss for lack of venue or, in the alternative, motion to transfer. (Doc. 11). The parties have filed briefs in support of their respective positions, (Docs. 11, 19, 23), and the motion is ripe for resolution. After carefully considering the foregoing, the Court concludes that the motion to dismiss is due to be denied and the motion to transfer is due to be granted.
