OPINION OF THE COURT

Memorandum.

Ordered that the judgment of conviction is reversed, on the law, and, as a matter of discretion in the interest of justice, the accusatory instrument is dismissed.

This criminal action was brought based upon defendant’s alleged violations of the Code of the Village of Pelham Manor (Code) by having changed the use and occupancy of a “carriage house” located at 50 Shore Road, Pelham Manor, New York without obtaining a “permit” therefor (Code § 210-5 [C]) and without obtaining a certificate of occupancy therefor (Code § 210-30), and by using/occupying the premises…
