—Order unanimously reversed on the law, motion denied, indictment reinstated and matter remitted to Monroe County Court for further proceedings on indictment. Memorandum: County Court erred in dismissing the indictment based on the People’s failure to notify defendant of his right to testify in a prospective Grand Jury proceeding. Defendant was arraigned on a felony complaint in Rochester City Court.
