Upon return to a writ of review issued by this court it is shown that on January 6, 1928, one Clarence Cates was by the county attorney informed against for the crime of an attempt to commit rape. It is charged by the information that on or about November 23, 1927, the defendant “did then and there wilfully, unlawfully, feloniously, violently, and forcibly make an assault upon * * * a female not then and there the wife of the said Clarence Cates, with the intent then and there, feloniously and by force and violence, to carnally know and ravish” her “and accomplish with her an act of sexual…
