I respectfully concur in the result reached by the majority, and agree that the case is controlled by our previous opinion in Popich Bros. Water Transport, Inc. *108v. Gulf Coast Marine, Inc., 97-0902 (La.App. 4 Cir. 1/14/98), 705 So.2d 1267.
